The Department of Labor has issued a regulation that eliminates the requirement that employers place print newspaper advertisements in the area of intended employment of H-2A employees. Instead, DOL will now require job advertisements to be placed on SeasonalJobs.dol.gov.

Previous regulations required an employer to place two print advertisements that meet certain requirements in a newspaper of general circulation serving the area of intended employment, in addition to contacting the former U.S. workers whom it employed in the previous year.

AFBF submitted comments to DOL urging the agency to offer employers the option of using either online or newsprint advertisements as a way of fulfilling the positive recruitment requirement. Read the Federal Register notice for additional details.
